The 2026 Ruling: 163 Days, Not 183
On 18 May 2026 Spain’s Audiencia Nacional annulled the assessment and penalty for the 2011 tax year in full — a matter in dispute worth more than €55 million in income and wealth tax.
The reasoning goes to the heart of every case against her. Spanish law taxes worldwide income for anyone present in Spain more than 183 days in a calendar year. The court found she had been there 163 days in 2011 — twenty days under the threshold — and that the administration had proved neither an economic centre of interests nor family ties in Spain.
Two findings are worth quoting in substance. On her Bahamas tax residency certificate, the court held that whether the Bahamas was a tax haven in 2011 is irrelevant, because she had proved at least 183 days outside Spain. And on the doctrine of “sporadic absences”, it held that an absence lasting more than 183 days cannot be called occasional — otherwise the concept of habitual residence would be stripped of all sense.
But the money has not moved. The tax agency announced an appeal to the Supreme Court and pays nothing until the judgment is final. Anyone recording €55 million as an asset today is recording a contingent claim as cash.
One precision point: press reports of “€60 million” or “$64 million” add estimated interest and costs. Only the €55 million is quantified by the court.
What the 2023 Settlement Actually Cost
The trial over the years 2012 to 2014 ended in Barcelona on 20 November 2023 after roughly eight minutes, when she accepted a settlement and more than a hundred witnesses became unnecessary. The components are almost always merged into a single wrong number:
- About €17.5 million in back tax and interest — already paid before the hearing
- €7.3 million fine
- €432,000 as a day-fine replacing a three-year suspended sentence
- About €25.2 million in total
The €14.5 million widely quoted is something different again: it is the amount alleged to have been evaded, not the amount paid. Prosecutors had originally sought eight years and two months in prison plus €23.7 million.
A separate matter concerning 2018 was dismissed in May 2024 for absence of intent — the judge finding no indication she had knowingly and voluntarily omitted anything. Notably, the dismissal was requested jointly by the prosecution, the state attorney and the Catalan tax agency. She had already paid €6.6 million on that year voluntarily and without admitting liability. Whether any of it came back is not documented.

The Bottom Line
Three reasons a single number cannot be honest here, any one of which would be enough.
A sum in the tens of millions is legally unresolved. Depending on the appeal, her net position swings by an amount worth 15 to 20 per cent of the figure aggregators publish. Her biggest ever sale has no known price. And the estimates are wrong in both directions — inflating a record deal by a factor of three to four, while never subtracting the €86 million that actually left her accounts.
That last point is the one worth keeping. A €55 million assessment you have paid is not a lawsuit outcome to be noted in passing. It is money that is gone — and, for now, still gone.
